1. About these terms

percs.lol lets you build a personal page and publish it at percs.lol/yourname. percs.lol is run by an individual based in Chicago, Illinois, USA ("percs.lol", "we", "us").

These terms are an agreement between you and us. By logging in, creating a page, or otherwise using percs.lol, you agree to these terms, our Privacy Policy, our Content Rules and our Copyright Policy. If you don't agree, don't use percs.lol.

2. Who can use percs.lol

• You must be at least 13 years old. If you are under 18, or under the age of majority where you live, you may only use percs.lol with the permission of a parent or legal guardian, who agrees to these terms for you.
• You must have a Discord account in good standing, because logging in works through Discord.
• You must not be barred from using services like this under the law that applies to you, and must not have been banned from percs.lol before.
• Each person may have one account, and each account has one page.

If we learn that someone under 13 has an account, we will delete it.

3. Your account

You log in with Discord. Keep your Discord account secure: anyone who can log in to it can change your percs.lol page. You are responsible for what happens on your account. Tell us at legal@percs.lol if you think someone else has access to it.

You can delete your account at any time from your account page. Deleting it removes your page, your draft, your uploaded files and your badges.

4. Your page and your content

"Your content" means everything you add to percs.lol: text, images, audio, links, designs, your handle, and the account names you connect (such as a Discord ID or Last.fm username).

• You keep ownership. We don't claim ownership of your content.
• You give us a license to run the service. You grant percs.lol a worldwide, non-exclusive, royalty-free license to host, store, copy, display, perform (for audio), resize and reformat (for example, to fit phones and desktops), and distribute your content, only as needed to operate, provide, secure and improve percs.lol. This license ends when you delete the content or your account, except for copies kept for a limited time in backups and caches, or as required by law.
• Your page is public. Anyone with the link can see a published page, and search engines and other people may find, copy or share it. Don't put anything on your page that you want to keep private, including other people's personal information.
• You confirm you have the rights. You promise that you own your content or have permission to use it, including any music, images or logos, and that it follows these terms and the law.

We don't review pages before they go live, and we are not responsible for content that users post. Content on a page belongs to and reflects the person who made it, not percs.lol.

5. Content Rules

Your page must follow our Content Rules. They are part of these terms.

6. Handles

• Handles (the "yourname" in percs.lol/yourname) are first come, first served.
• You may not pick a handle that impersonates a person, brand or organization, that infringes a trademark, or that misleads people about who runs the page.
• You may not register handles to hold, sell or trade them. Handles are not your property and can't be sold or transferred.
• Some handles are reserved. We may change, remove or reclaim a handle, for example to resolve an impersonation or trademark complaint or to enforce these terms.

7. Badges

Badges are given out only by percs.lol, at our discretion. They have no monetary value, can't be bought, sold or transferred, and can be removed at any time. You may not claim or imitate a badge you weren't given.

8. Other services

percs.lol works with services run by other companies, including Discord (login and profile info), Spotify (embedded players), Last.fm (now playing) and Lanyard (Discord status). Your use of those services is governed by their own terms and privacy policies. Pages can link to other websites. We don't control and aren't responsible for other services or websites, or for what they show.

9. Copyright complaints

We respond to copyright complaints under the U.S. Digital Millennium Copyright Act. See our Copyright Policy for how to send a notice or counter-notice. We disable the accounts of repeat infringers in appropriate circumstances.

10. Removing content and accounts

We may, at any time and without notice, remove or hide content, unpublish a page, reclaim a handle, remove badges, or suspend or delete an account if we believe it breaks these terms or the Content Rules, creates risk or legal exposure for percs.lol or others, or if the law requires it. We may report illegal content to the authorities. We try to act fairly and explain our decisions when we can, but we are not required to host any content.

If you think we made a mistake, email legal@percs.lol with your handle and what happened.

11. Using the service fairly

Don't:

• try to break into, disrupt, overload or get around the security or limits of percs.lol;
• access other people's accounts or data;
• use bots or scripts to create accounts or pages, or to scrape percs.lol beyond normal browsing;
• use percs.lol to host files for use elsewhere, or as a file-sharing service;
• use percs.lol to send spam, malware, or phishing;
• resell or rebrand percs.lol.

If you find a security problem, please tell us privately at legal@percs.lol instead of exploiting it.

12. Changes to the service

percs.lol is currently free. We may change features, add limits (such as file sizes), introduce paid options, or stop offering percs.lol, in whole or in part, at any time. If we shut percs.lol down, we will try to give reasonable notice so you can save your content.

13. Disclaimers

percs.lol is provided "as is" and "as available". To the fullest extent the law allows, we make no warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, title and non-infringement. We don't promise that percs.lol will be uninterrupted, secure, error-free, or that content will be preserved. Keep your own copies of anything important.

14. Limits on liability

To the fullest extent the law allows, percs.lol will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, data, goodwill or content, arising from or related to your use of percs.lol, even if we were told such damages were possible. Our total liability for all claims related to percs.lol is limited to the greater of the amount you paid us in the 12 months before the claim (currently zero) or US $50.

Some places don't allow some of these limits, so they may not all apply to you. Nothing in these terms limits liability that can't be limited by law.

15. Indemnity

To the extent the law allows, you agree to defend and hold harmless percs.lol from claims, losses and costs (including reasonable legal fees) that arise from your content, your use of percs.lol, or your breaking these terms or the law. If you are under 18, your parent or guardian agrees to this for you.

16. Governing law and disputes

These terms are governed by the laws of the State of Illinois, USA, and applicable U.S. federal law, without regard to conflict of law rules. Before starting a legal claim, please email legal@percs.lol and give us 30 days to try to resolve it informally. Any legal claim must be brought in the state or federal courts located in Cook County, Illinois, and you and we consent to the jurisdiction of those courts. Either of us may bring a qualifying claim in small claims court instead. If you live in a country whose consumer laws give you the right to sue in your local courts, these terms don't take that right away.

17. Changes to these terms

We may update these terms. When we do, we'll change the date at the top. If a change is significant, we'll also make it noticeable on percs.lol, for example on the login page or in the editor. If you keep using percs.lol after a change takes effect, you accept the updated terms. If you don't agree, stop using percs.lol and delete your account.

18. General

• These terms, together with the policies they link to, are the whole agreement between you and us about percs.lol.
• If any part is found unenforceable, the rest stays in effect.
• If we don't enforce a part of these terms right away, we can still enforce it later.
• You may not transfer your rights under these terms. We may transfer ours, for example if percs.lol is sold or handed to someone else.
• Sections that by their nature should survive (such as ownership, licenses needed for backups, disclaimers, limits on liability, indemnity and disputes) survive after your account ends.
